Ordinance No. 7849

AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 7695 OF THE CITY OF MANILA REFERRING TO DISPOSAL OF GARBAGE BY PROVIDING A HIGHER PENALTY FOR VIOLATION THEREOF AND PROVIDING SUB-SECTIONS THERETO.

Be it ordained by the City Council of Manila THAT:

Section 1. Section 4 of Ordinance No. 7695 is hereby amended, to read as follows:

"Section 4." Any person found violating this Ordinance shall be punished with imprisonment of not less than three (3) months nor more than one (1) year or a fine of nor less than THREE THOUSAND PESOS (P3,000.00) nor more than FIVE THOUSAND PESOS (P5,000.00) or both, such fine and imprisonment at the discretion of the court.

"Section 4 (a)" The Punong Barangay, the Kagawads, the Secretary and the Treasurer of the Sangguniang Barangay and the Sangguniang Kabataan Chairman of each barangay are hereby deputized to enforce this Ordinance.

"Section 4 (b)" The Barangay in whose jurisdiction the person found violating this Ordinance is apprehended, shall be entitled to thirty percent (30%) of the total amount collected in the form of fines from the such violation, which amount shall be remitted by the City Treasurer to the said Barangay on a quarterly basis without delay and shall not be subjected to any lien or holdback.

"Section 4 (c)" The City Treasurer shall formulate the guidelines to implement the the provisions of the immediately preceeding sub-section within 15 days from the approval of this Ordinance.

Section 2. This Ordinance shall take effect upon its upproval.
