AN ORDINANCE
REQUIRING THE PROVISION OF GARBAGE RECEPTACLES IN ALL PUBLIC UTILITY VEHICLES
IN THE CITY OF MANILA. PROVIDING FOR PENALTIES FOR VIOLATION THEREOF, AND
AMENDING/REPEALING FOR THE PURPOSE ORDINANCE NO. 6747 AND ORDINANCE NO. 7436
Be it ordained
by the City Council of Manila, THAT:
Section 1.
-All owners and/or operators of public utility vehicles (jeepneys, buses, tricycles,
light rail transit, trains, ferry boats, calesas and pedicabs and other vehicles
for hire) are hereby required to provide garbage receptacles inside their vehicles
for the use of the commuting public.
Section 2.
- the garbage receptacles shall be made either of tin or plastic, with holding
brace and shall be painted canary yellow and marked in black letters-- "KEEP
MANILA CLEAN AND BEAUTIFUL". The receptacles, which should have a movable cover
shall contain a minimum capacity of one gallon depending on the size and passenger
capacity of the vehicles; PROVIDED, that buses, LRT trains, ferry boats, shall
be provided with at least three (3) garbage receptacles while other public utility
vehicles covered by this Ordinance shall be provided with at least one (1) garbage
receptacle each.
Section 3. -
Owners, operators, drivers and conductors of public utility vehicles shall ensure
that the garbage receptacles are emptied and their vehicles are washed and clean
before their units are dispatched in the morning, or as often as may be necessary
during the day or night such vehicles are in operation.
Section 4.
- Any violation of the provisions of the Ordinance by any person or owner and/or
operator of public utility vehicles shall upon conviction, be penalized by a
fine of either P1,000.00 or imprisonment of not more than thirty (30) days,
or both at the discretion of the Court. In the case of a juridical person, the
President or the Manager shall be liable therefor. The penalty herein provided
shall likewise be imposed on any driver of a public utility vehicle who fails
or neglects to install or set in proper order the herein required garbage receptacle
earlier provided by vehicle owners or operators.
Section 5.
- The Office of the Mayor shall make the necessary representation with the Land
Transportation Franchising and Regulatory Board (LTFRB) and other government
agencies so that prior compliance with the Ordinance shall be made prerequisite
for the renewal of franchises and licenses of public utility vehicles operating
within the territorial jurisdiction of the City of Manila.
Section 6. -
This Ordinance amends/repeals Ordinance No. 6747 and Ordinance No. 7436, as
the case may be.
Section 7.
- This Ordinance shall take effect sixty (60) days after its approval to afford
sufficient time to all concerned to comply with its provisions.
