DENR Administrative Order No. 142

SUBJECT: GUIDELINES ON THE DISPOSITION OF CONFISCATED WILDLIFE SPECIES.

Pursuant to Section 80 of P.D. 705, as amended, Executive Order No. 192, dated June 10, 1987 and Act No. 2590, as amended and other existing policies on the protection and conservation of wildlife species ( both flora and fauna), the following guidelines are hereby promulgated for the information and guidance of all concerned.

Seizure and Confiscation

1. All illegally possessed, collected and transported wild flora and fauna shall be seized or confiscated by authorized personnel of the Department of environment and Natural resources (DENR);

2. All seized wild flora and fauna shall be deposited at the wildlife rescue centers which shall be established immediately by all the DENR Regional Offices. Wildlife species confiscated by the National Capital Region (NCR) shall be deposited at the Protected Areas and wildlife Bureau (PAWB);

3. The seizing officer shall acquire all the necessary information regarding the confiscated flora and fauna. A seizure receipt prepared for the purpose shall be filled up by the seizing officer in triplicate.

4. in case of death, efforts should be done to preserve or stuff the confiscated animals. PAWB shall be notified of the death.

5. After seizure/confiscation, and should evidence warrants, criminal action shall be instituted in accordance with Section 80 of PD 705.

6. PAWB shall maintain a data bank of all DENR confiscated wildlife species.

Disposition of Confiscated Wildlife species

7. Confiscated live wildlife species shall be disposed either by:

a. releasing back the animals to the natural habitat;

b. donating to government projects which need the animals or plants, as the case may be;

c. donating and/or exchanging with reputable institutions (Administrative Order No. ) or,

d. loan to reputable institutions (Administrative Order No. 45).

8. Confiscated wildlife by-products shall be disposes by donating to public or private schools for educational purposes.

A quarterly report, in accordance with the prescribed form, pertaining to the implementation of this Order shall be submitted to the Secretary, DENR, copy furnished PAWB.

This Administrative Order takes effect immediately and revokes all Orders inconsistent herewith.
